Terms of Service

These terms govern your use of the MerchantRates website and the free comparison service we provide. Please read them carefully. Nothing in these terms excludes rights you have under the Australian Consumer Law.

1. Acceptance of these terms

By accessing or using this website, or by submitting an enquiry through it, you agree to be bound by these Terms of Service. If you do not agree, please do not use the website. This website is operated by MerchantRates, an Australian Merchant Payment Advisory (AMPA) initiative ("MerchantRates", "we", "us", "our").

2. About our service

MerchantRates provides a free comparison and introduction service. We compare merchant payment rates across Australian providers and, where appropriate, introduce you to a provider that may offer a better arrangement for your business. We are an independent service and are not a bank or payment provider. Using our service is free to you; we are paid by providers if you are placed with them (see our About page).

3. Indicative rates are not offers

Any rates, savings figures or provider information shown on this website are indicative only and are provided for general information. They are not offers, quotes or guarantees. Your actual rate depends on your industry, card mix, transaction volume, terminal setup and the assessment of the relevant provider. Indicative figures may change without notice.

4. No guarantee of specific savings

While our purpose is to help you find a lower merchant rate, we do not guarantee that you will achieve any particular saving, except as expressly set out in our separate $100 Guarantee Terms & Conditions. The $100 Guarantee is subject to the eligibility criteria and conditions described on that page.

5. Your responsibilities

To use our service effectively, you agree to provide accurate and complete information, including accurate details of your current rates and statements where requested for assessment. You are responsible for any decision to switch providers and should review a provider's own terms before entering into an agreement with them.

6. Intellectual property

All content on this website — including text, graphics, logos, layout and design — is owned by or licensed to MerchantRates and is protected by intellectual property laws. You may view and print content for your own reference, but you must not copy, reproduce, republish or distribute it for commercial purposes without our prior written permission.

7. Limitation of liability

To the maximum extent permitted by law, MerchantRates is not liable for any loss or damage arising from your use of, or reliance on, this website or the information on it, including indicative rates. Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where our liability cannot be excluded but can be limited, our liability is limited to the maximum extent permitted by law.

8. Third-party links and providers

This website may contain links to third-party websites, and our service may introduce you to third-party payment providers. We are not responsible for the content, products, services or terms of any third party. Any agreement you enter into with a provider is between you and that provider.

9. Governing law

These terms are governed by the laws of Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Australia in relation to any dispute arising from these terms or your use of the website.
